Terms of Use for Parents

These terms of use exist in German and English. The contracting company is a German sole proprietorship, and German law applies. In case of any discrepancy between the two versions, the German version is authoritative.

Coaches who use Nura Sleep in their practice are covered by the Terms for Coaches instead.

1. Provider and scope {#s1}

  1. Nura Sleep is operated by DoryAI, owner Georg Ortner, Rigaer Straße 47A, 10247 Berlin, Germany (“Nura”, “we”).
  2. These terms of use govern the use of the Nura Sleep app and your Nura Sleep account by parents and other people with parental responsibility (“you”). They apply from the moment you create your account.

2. What Nura Sleep is {#s2}

  1. Nura Sleep is an app for recording your child’s day for your sleep coaching: night sleep, naps, meals, activities, notes and the bedtime ritual. You see your entries in the journal and the daily routine your coach creates for your child, and you chat with your coach.
  2. You can speak or type entries. Nura Sleep turns them into structured entries with the help of AI services. Mistakes can happen or details can be missing, so check your entries in the journal and correct them where needed. Incomplete entries are still saved and shown as incomplete.
  3. Nura Sleep is not a medical device and does not replace a medical examination or medical advice. If you are worried about your child’s health, contact your paediatrician, or in an emergency call 112.

3. Your coaching: a contract with your coach, not with Nura {#s3}

  1. You agree your sleep coaching exclusively with your coach. The scope of the coaching, fees, payment, appointments and ending the coaching are between you and your coach. Nura is not a party to that contract.
  2. Nura only provides the software your coach uses for the coaching. The daily routine, plans and replies in the chat come from your coach. Your coach, not Nura, is responsible for that content.
  3. Coaches are self-employed and are not employees or representatives of Nura. We review coach accounts before activating them, but we do not vouch for a coach’s qualifications or the quality of the coaching.

4. Cost {#s4}

Using Nura Sleep is free for you. Nura charges you nothing, and you buy nothing in the app. You pay your fee directly to your coach.

5. Your account {#s5}

  1. You create your account through the personal link your coach sends you by email. The information you give must be accurate.
  2. You may only record entries for children for whom you have parental responsibility, or for whom a person with parental responsibility has authorised you.
  3. Your account is personal and not transferable. Keep your password secret and tell us if you suspect misuse.

6. Acceptable use {#s6}

You use Nura Sleep only to record your child’s day and to communicate with your coach. In particular, you

7. Your data {#s7}

  1. The rights to your entries, photos and messages remain with you. You grant Nura the right to store and process them and show them to your coach, to the extent necessary to operate Nura Sleep.
  2. Your coach sees your child’s details, your journal and your chat. That is what Nura Sleep is for.
  3. Nura processes your data as a controller in accordance with our Privacy Policy, which also sets out your rights under the GDPR.
  4. You can ask for your account and your data to be deleted at any time by emailing georg@dory-ai.com.
  5. Your coach can also permanently delete your family in Nura Sleep – your account, the accounts of other parents in your family, your children’s details, all entries, plans and the chat. Your coach may do this when you ask for deletion or when your coaching has ended; in the second case your coach tells you beforehand. The deletion cannot be undone.
  6. The chat and plans belong to your coaching with your coach. If your coach deletes that coaching, or your coach’s account ends, the chat – including your own messages – and the plans are deleted. Your journal entries and your children’s details are kept in that case. If you want to keep messages, save them yourself beforehand.

8. Availability {#s8}

Nura Sleep is a free service for you. We aim for operation free of disruption but do not owe any particular level of availability. We develop the app continuously and may change, add or remove features.

9. Liability {#s9}

  1. Because Nura Sleep is free for you, Nura is liable only for intent and gross negligence.
  2. Nura is liable without limitation for injury to life, body or health, for fraudulently concealing a defect, and under the German Product Liability Act.
  3. Nura is not liable for the coaching provided by your coach (see section 3).

10. Ending use {#s10}

  1. You can stop using Nura Sleep at any time. To have your account and your data deleted, send us an email (section 7.4).
  2. Nura may end the contract of use with four weeks’ notice by email. The right to terminate without notice for good cause, for example for a serious breach of section 6, remains unaffected.
  3. If your coach deletes your family (section 7.5), this contract of use ends when your account is deleted.
  4. The end of your coaching alone does not end this contract of use.

11. Changes to these terms of use {#s11}

If we change these terms of use, we will tell you by email in advance. Changes that significantly restrict your rights only take effect with your consent. If you do not agree with a change, you can stop using Nura Sleep at any time.

12. Final provisions {#s12}

  1. The law of the Federal Republic of Germany applies. If your habitual residence is in another country, such as Austria or Switzerland, the mandatory consumer protection provisions of that country remain unaffected.
  2. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
  3. If any provision of these terms of use is invalid, the remaining provisions stay valid. The statutory provisions take the place of the invalid provision.
